Terms and Conditions - Guests

1. Jurisdiction

The laws of the Republic of South Africa govern this agreement. You agree that any cause of action arising from this agreement shall be instituted and heard in the appropriate court within South Africa.

2. Booking Terms & Guest Responsibilities

You acknowledge and accept the responsibilities associated with making use of a self-service booking platform operated by Etna’s Southern Tip (Pty) Ltd. These responsibilities include, but are not limited to:

• Ensuring that you have selected the correct property with the required features
• Familiarizing yourself with the area and surroundings of your chosen destination
• Ensuring that all booking details are accurate

By proceeding with a booking, you confirm that you have read, understood, and accepted these Terms and Conditions.

3. Use of Premises at Own Risk

You acknowledge that you use the premises and all facilities entirely at your own risk.

You hereby indemnify and hold harmless Etna’s Southern Tip (Pty) Ltd and any of its directors, homeowners, employees, officers, representatives, agents, consultants, suppliers, service providers or sub-contractors (“Indemnified Parties”) against any loss, damage, injury (including personal injury or death), liability, claims or costs of whatsoever nature, whether direct, indirect, incidental, consequential or otherwise, arising from or in any way related to your stay.

4. Damage, Loss & Liability

You accept full responsibility for:

• Any breakages, damages or losses during your stay
• Any damage caused by any person forming part of your group or visiting the property

Etna’s Southern Tip reserves the right to recover such damages and/or institute legal action where necessary.

5. Occupancy & Use Restrictions

• Only the permitted number of guests (including children) may occupy the property
• Exceeding this number will result in immediate termination of the stay without refund
• No loud parties, 21st, matric or bachelor-type gatherings are allowed
• No under 21’s without proper adult supervision

Etna’s Southern Tip reserves the right to require guests to vacate the property immediately in the event of non-compliance.

6. Noise & Behaviour

Guests shall not create any disturbance or nuisance to neighbouring properties.

• No excessive noise
• No rowdy or disruptive behaviour
• No parties of any kind

Failure to comply may result in immediate eviction without refund.

7. Right of Admission Reserved

Etna’s Southern Tip and/or the property owners reserve the right to refuse or terminate occupancy if:

• The property is used recklessly
• Damage is caused or likely to be caused
• Safety of the property or others is compromised

No refunds will be issued in such cases.

8. Property Rules

• No furniture may be moved under any circumstances
• No axes may be used for chopping wood
• Alarm systems must be used as instructed
• Pets (where allowed) are strictly prohibited on furniture
• Smoking is not permitted inside any property

9. Check-in / Check-Out

Check-in: 14:00
Check-out: 10:00

Keys will only be handed over once full payment has cleared.

10. Payment & Refunds

• Full payment must reflect in Etna’s account prior to arrival
• No refunds will be given for shortened stays
• Bookings cannot be changed upon arrival

11. Cancellation Policy

• 31+ days before check-in: 20% cancellation fee
• 30 days or less: 100% cancellation fee

12. Load Shedding Disclaimer

Guests are responsible for making their own provision for load shedding, including bringing lights or lanterns.

13. Insurance

Guests are strongly advised to obtain adequate travel and personal insurance to cover:

• Injury
• Loss
• Cancellation
• Theft
• Any other unforeseen risks

Etna’s Southern Tip does not provide such cover.

14. Dissatisfaction

Any dissatisfaction must be reported immediately during your stay to allow for possible resolution.

15. General

These Terms and Conditions apply to all bookings and form the entire agreement between the parties.
